Attorney Jeff Herman Talks About The Harvey Weinstein Case

He has written that if Harvey Weinstein is able to avoid prison time for sexual harassment and sexual assault charges it will highlight just how important civil trials are. In a criminal trial, the prosecutors must prove beyond any reasonable doubt that a person committed the crime for which they are accused. This can be a very difficult thing to do which can result in guilty people being found not guilty.


The legal bar in a civil trial, though, isn’t as high Jeff Herman has said. The side with the preponderance of evidence on its side prevails in civil law. Unfortunately, it is a regular occurrence that the victim of sexual assault can only find justice in a civil trial not criminal because it is often a “he-said-she-said” issue. It is also the case that in a criminal trial the case is regarded as one against the state and the state is the one that brings it to court.


On the civil law side, Jeff Herman says that the accuser gets to decide the direction they want to take the case. Unlike in a criminal trial, they don’t just appear as a witness for the prosecutor. If they win the civil case they can be entitled to money damages in order to be fully compensated for what happened to them. In a criminal trial, people are only compensated for any financial losses. In a civil trial, though, they can sue for things such as emotional damage, psychological treatment, and other issues.


Due to all of this, Jeff Herman says that civil litigation is generally the only way that any victim of sexual abuse will gain any justice. He says that civil cases are easier to prosecute than criminal ones because the victim’s lawyer just needs to prove that the accused more than likely committed the crime.
